Terms of Service

These Terms of Service ("Terms") govern your use of the Lobstercom service (the "Service").

The Service is owned and operated by RiverCity Internet Group L.L.C. ("Company," "we," "us," or "our"). Lobstercom is a brand operated by RiverCity Internet Group L.L.C.

By accessing or using the Service, you agree to these Terms.

1. Description of Service

The Service provides:

  • Assignment of a dedicated phone number
  • SMS messaging (inbound and outbound)
  • Voice calling functionality
  • Optional hosted AI voice processing
  • Usage controls and billing tools

Telecommunications functionality is powered by third-party providers.

We do not guarantee uninterrupted service, message delivery, or call completion.

2. Eligibility

You must:

  • Be at least 18 years old
  • Provide accurate account information
  • Use the Service in compliance with applicable laws

Consumer plans are for personal use only. Business, marketing, political, or bulk messaging use is prohibited unless explicitly authorized.

3. Acceptable Use

You may not use the Service for:

  • Spam or unsolicited messaging
  • Bulk or automated marketing
  • Political campaign messaging
  • Fraud, phishing, or impersonation
  • Harassment or abusive conduct
  • Illegal activities
  • Circumventing carrier safeguards
  • Generating excessive or abusive traffic

We reserve the right to suspend or terminate accounts that violate this policy without notice.

4. Messaging and Voice Usage

Your subscription includes a defined monthly allocation of:

  • SMS segments (inbound + outbound combined)
  • Voice minutes (inbound + outbound combined)

Overage Charges

If enabled, usage beyond included amounts will be billed at the published overage rates.

Users may:

  • Set outbound usage caps
  • Enable or disable overages
  • Set maximum monthly overage limits

We may throttle, restrict, or suspend usage that appears anomalous or abusive.

5. Hosted AI Voice Processing

If you enable hosted AI voice features:

  • Voice interactions may be processed on Company-managed servers.
  • Usage may be billed per minute unless included in a bundle.
  • Performance may vary based on system load.

The Company is not responsible for inaccuracies or errors generated by AI systems.

6. Telecommunications Compliance

You are responsible for complying with:

  • TCPA (Telephone Consumer Protection Act)
  • A2P messaging regulations
  • Opt-in and opt-out requirements
  • Applicable federal, state, and local laws

We may suspend numbers or accounts if required by carriers, regulators, or law enforcement.

7. Phone Number Assignment

Phone numbers provided through the Service:

  • Are leased, not owned
  • Remain subject to carrier policies
  • May be reclaimed if inactive, abusive, or required by regulation

We do not guarantee permanent retention of any specific number.

8. Fees and Payment

You agree to:

  • Pay all subscription fees in advance
  • Pay applicable overages
  • Maintain valid payment information

Failure to pay may result in suspension, number release, or termination.

All fees are non-refundable except where required by law.

9. Suspension and Termination

We may suspend or terminate service if:

  • You violate these Terms
  • Your usage threatens carrier relationships
  • Fraudulent or abusive activity is detected
  • Required by law or third-party providers

We may impose rate limits or other safeguards at our discretion.

10. Limitation of Liability

To the maximum extent permitted by law:

The Company is not liable for:

  • Message delivery failures
  • Call routing issues
  • Carrier filtering
  • AI output errors
  • Indirect or consequential damages

Total liability shall not exceed the fees paid by you in the three (3) months preceding the claim.

11. No Warranty

The Service is provided "as is" and "as available."

We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.

12. Indemnification

You agree to indemnify and hold harmless RiverCity Internet Group L.L.C. from claims arising out of:

  • Your use of the Service
  • Violations of law
  • Improper messaging
  • Content transmitted through your assigned number

13. Privacy

Use of the Service is also governed by our Privacy Policy.

We may log messages and calls for:

  • Compliance
  • Fraud prevention
  • Service improvement

14. Modifications

We may update these Terms at any time. Continued use of the Service constitutes acceptance of revised Terms.

15. Governing Law

These Terms are governed by the laws of the State of Texas.
